Terms of Usage & Privacy Statement
The Terms of Usage and Privacy Statement govern the relationship between Hiring Companies and Staffing Agencies. In order to become a member, all users must review and agree to the Terms of Use and Privacy Statement. Dispute Resolution
Disputes are rare on the PreferredVendor tool, but when they occur, we use a Dispute Resolution Process. We will act as a mediator to understand the issues and work to reach a resolution between parties. If mediation is unsuccessful, either party can enforce the Terms of Usage to the full extent of the law.
Member Hiring Companies
There are 4 steps in the Hiring Company membership approval process.
- Hiring Companies must view an online demonstration of the Preferredvendor tool.
- Hiring Companies must agree to the Terms of Usage and Privacy Statement.
- Hiring Companies must complete their Hiring Company Profile, which contains the company defined Fee Agreement and Guarantee Terms.
- Hiring Company Profile information must be reviewed for accuracy prior to a Hiring Company posting jobs.
Hiring Company Overview
Hiring Companies post Direct Hire, Temporary, Temp-to-Perm and Contract jobs that are designated for Staffing Agency Fulfillment and determine the fee they are willing to pay on a job-by-job basis. Once a Staffing Agency successfully fills a job the Hiring Company pays the Staffing Agency based on the details outlined in the Fee Agreement and Guarantee Terms which are part of the Hiring Company Profile.
Fee Agreement and Guarantee Terms
The Fee Agreement and Guarantee Terms eliminate the need for Pre-Negotiated Vendor Agreements. Each Hiring Company customizes their own Fee Agreement and Guarantee Terms which not only communicates to the Staffing Agencies how long it will take to receive payments for Direct Hire, Contract, Temporary and Temp-to-Perm invoices but how long of a guarantee the Hiring Company would like for the candidates they hire through the PreferredVendor tool.
Previously Submitted Candidates
Hiring Companies are not responsible for paying Staffing Agencies for a hired candidate if they have previously received that candidate’s resume from any other source within the last six (6) months.
Non-Solicitation
Staffing Agencies using the PreferredVendor tool are prohibited from recruiting employees from any Hiring Company with whom they made a placement during the previous one year period.
Confidentiality
Staffing Agencies using the PreferredVendor tool are legally required to keep information that they learn from Hiring Companies confidential.
Member Staffing Agencies
There are 4 steps in the Staffing Agency membership approval process.
- Staffing Agencies must view an online demonstration of the PreferredVendor tool.
- Staffing Agencies must agree to the Terms of Usage and Privacy Statement.
- Staffing Agencies must complete their Staffing Vendor Profile.
- Staffing Vendor Profile information must be reviewed for accuracy and “Preferred Vendor” status requirements must be met prior to Staffing Agencies submitting candidate resumes through the PreferredVendor tool.
Staffing Agency Overview
Staffing Agencies gain “Preferred Vendor” status with key Hiring Companies nationwide and can search for specific types of jobs to fill based on vendor defined criteria. By virtue of a Staffing Agency submitting a candidate resume to a Hiring Company they are agreeing to the Fee Agreement and Guarantee Terms outlined in the Hiring Company’s Profile and the Fee indicated on the job posting. Once a Staffing Agency successfully fills a job the Hiring Company pays the Staffing Agency based on the details outlined in the Fee Agreement and Guarantee Terms which is part of the Hiring Company Profile.
Candidate Representation
Staffing Agencies are not allowed to submit candidate resumes to Hiring Companies without the knowledge and approval of the candidate.
Candidate Ownership
Staffing Agencies own candidates they submit for a period of six (6) months from the day the candidate is submitted. If the Hiring Company hires the candidate during this period for any job, the Hiring Company must pay the Staffing Agency a fee.
Duplicate Submissions
The PreferredVendor tool should block duplicate submissions. In the unlikely event that the tool fails to block a duplicate submission, candidate ownership will be determined by the Staffing Agency who first submitted the candidate, as determined by the time and date stamp on the submissions.
